摘 要：在我国，一般而言自然资源属于国家所有。国有企业是国有自然资源利用的一个重要主体，但国有企业使用自然资源的法律机制及其实践造成诸如垄断等问题，以致个人、其他组织及其他企业的国有自然资源使用权受到排挤，甚至侵害。为此，应对国有企业使用国有自然资源机制进行合理化改造。主要方法是对国有企业使用自然资源的权利进行限制，具体措施是，将国有企业分为公益性国有企业和商业性国有企业，对前者的国有自然资源使用权应积极保障，而对后者的国有自然资源使用权应严格限制。93237

伴随我国产业结构的变动和社会主义市场经济的迅速发展，国有自然资源使用权逐渐被人们所重视。自然资源是我们赖以生存和发展的重要基石。它是指在一定的时间条件下，可以给我们带来经济效益并且能够提升人们现在和将来的利益的自然环境要素的总称。但是，在经济发展的同时也带来了国有自然资源的不足以及我国在国有自然资源分配上的不合理等问题，比如国家大量地把国有资源使用权赋予国有企业，导致了垄断、从而直接排挤并限制了其他主体的使用权，进而引发了相对严重的社会矛盾。此种矛盾又直接引发了社会的不公平以及不公正，也让一些不法分子有机可乘，侵吞国有资产,滋生贪污腐败，从而使之变成了私人去获取经济利益的一种工具。具体而言，为了保障国有自然资源使用的公平公正，改善国有自然资源在开发利用中的浪费与低效率问题，合理地运用市场机制的资源配置功能，应对国有企业使用国有自然资源机制进行合理化改造。主要方法是对国有企业进行分类，将国有企业划分为公益性国有企业和商业性国有企业，对于公益性国有企业的国有自然资源使用权我们应积极保障，但是对于商业性国有企业的国有自然资源使用权应严格限制，以便更好地解决国有自然资源配置上的垄断等问题。 国有企业的国有自然资源使用权:http://www.youerw.com/faxue/lunwen_201051.html
