摘要：唐朝婚外情的类型根据主体有无特权，可以分为特权阶层的婚外情与普通民众的婚外情。婚外情产生的原因大致可分为婚姻不幸、长期分居、信仰变化、享有特权四个方面。唐朝法律通过从宽定罪、从重量刑、融礼入法等措施来规制婚外情现象，当代中国的法律要在尊重人权的基础上，合理吸收唐朝法律礼法结合的立法思想，适当借鉴唐朝法律出礼入刑的做法，追求相对公平，同时还要防止权力对法律的破坏，通过这些举措减少当代婚外情现象的发生。93376

一、引言

婚姻是男女之间的结合在法律上得到的认可，从古至今，婚外情现象总是屡禁不止，从平民百姓到王公贵族，无一例外。而在素有“脏唐臭汉”之称的唐朝，这种现象更是屡见不鲜，唐朝法律也制定了规制婚外情的条文，本文将以《唐律疏议》为视角，分析唐朝的婚外情。当今社会，由于男女平等观念日益形成，物质生活水平极大提升，人们之间的交往十分频繁，婚外情的现象相较于唐朝有过之而无不及，我们更应该借鉴唐朝法律中的优秀经验，将其运用到当代法律中，形成良好的社会风气。
