摘要在现阶段的法律实践中，各国立法在知识产权的取得、保护范围与期限、转让、消灭等方面的规定上均存在差异，导致各国在对知识产权的国际保护上出现明显的冲突现象，由此带来涉外知识产权法律适用上的问题。以下将从三个部分介绍涉外知识产权法律法律适用问题。第一部分介绍涉外知识产权的基础理论，包括涉外知识产权的基本概念、基本特点及解决法律冲突的理论途径等，第二部分以美国的《ALI原则》为例和欧盟的《罗马条例Ⅱ》为例，介绍美国和欧盟在知识产权冲突方面的理论实践，探讨其对我国的借鉴意义。第三部分重点论述我国的涉外知识产权法律适用规定，就确权、合同、侵权三方面对法律规定进行评析并据此提出完善的建议。26070

Title The Law Application of Foreign Intellectual Property
Abstract
In terms of the present legislation,different countries differ from the way of getting the Intellectual property rights,the scope of protection and protection period.Thus,here comes the law conflicts on the legal protection of intellectual property rights.We need solve the problem of the law application of foreign intellectual property appropriately.This article is pided into three parts altogether to introduce the law application of foreign intellectual property issues.The first part introduces the concept,basic characteristics of intellectual property rights and theories of law conflicts.The second part introduce American model law named<Intellectual Property:Principles Governing Jurisdiction,Choice of Law,and Judgments in Transnational Disputes>and try to fine some use for reference in China.The last part introduces law legislation on foreign intellectual property in China and try to find some targeted suggestions and opinions combining with the current legislation from the perspective of the ownership of intellectual property rights,assignment,tort liability in China.
