摘要伴随着社会的高速发展，人民生活水平的不断提高，我国社会主义法治体系的不断完善，我国公民的文权意识也在不断觉醒。夫妻之间地位的平等不再仅仅是法律文书上倡导的原则，更体现在我们生活中的方方面面。我国现行《婚姻法》中有关于离婚损害赔偿制度的规定，但是该制度的内容存在很大的不足，不能兼顾婚姻关系中可能会发生的所有侵权行为，对于是否应该建立婚内侵权损害赔偿制度，学界观点不一，司法实例的结果也有不同。28710
本文除了前言和结语以外，正文共分为四个部分：第一部分，简述婚内行为的定义，分析其概念、特征以及类型。第二部分，从保障人权、婚姻义务的内在要求、夫妻合法权益的保护以及符合世界立法潮流四个方面探讨了建立婚内侵权损害制度的可行性，从婚内损害赔偿制度的现实性基础、制度基础以及法律基础三个方面探讨了建立婚内侵权损害赔偿制度的可行性。第三部分，探讨了现如今我国婚内损害赔偿制度的立法现状以及存在的不足。第四部分，建立我国婚内损害赔偿制度的立法构想，增设非常财产制以及创立债权凭证制度。

Abstract
With the development of society, the socialist rule of law in China is increasingly perfect, civil rights awareness has been enhanced. The couple's equal status not only a legal advocacy principle, but also the actual need of real life. In marriage and family relations, one spouse damage the legitimate rights and interests of the other party, constitute the spouse's tort, in need of legal relief. China's current "marriage law" in the provisions of the system of compensation for porce damage, but the system there is insufficient, cannot completely cover all violations of marriage, the marital tort compensation system should be established, scholars have different views, the results of our case law are not the same, the author thinks that it is important to establish marital tort compensation system in our country has.
This paper except preface and conclusion, the text is pided into four parts. The first part, through an overview of marital behavior, analyzes its concept, characteristics and types. The second part, from the protection of human rights, marital obligations inherent requirement, husband and wife of the legitimate rights and interests protection and is on the principle of marital tort immunity denied four aspects to explore the feasibility of establishing marital tort system. From the marital damage compensation system as the realistic foundation and institution to hold a grudge, discusses the feasibility of establishing marital tort compensation system. The third part, discusses the nowadays China's marital damage compensation system of legislation and the lack of. The fourth part, the legislative conception of establishing China's marital damage compensation system. Analysis of the cognizance of marital tort, as well as the creation of property system and credit voucher system.
