摘要社会抚养费作为“计划生育”这一国策的辅助措施，近年来受到广大群众的关注。随着社会的不断发展，社会抚养费制度在实施过程中遇到了不少问题，受到越来越多的争议。同时，社会抚养费征收的有关问题也备受群众垢病。本文通过分析社会抚养费征收过程中的自由裁量权、社会抚养费的收支是否应公开、域外超生是否需要缴纳社会抚养费、“单独”夫妻抢生二孩是否需要缴纳社会抚养费等公众比较关注的问题，以提出自己的看法和建议，以更好的实现社会抚养费的功能，以建立更完善的社会抚养费的法律制度。希望能消除社会抚养费这一制度在运用过程中的产生的负面影响，实现社会的公正公平。45367

Abstract
Social support is an auxiliary measure of the national policy, “Family planning”, which has been extensively concerned for the past few years. However, with the incessant development of society, the legal system of social support meets some problems in its implementation process and becomes more and more controversial. Meanwhile, the levy of the Social support is reproached by the public. In order to come up with my own opinions and suggestions, and achieve the function of the Social support more better, additionally, establish a more perfect legal system of Social support. This paper based on the analysis of the problem which is concerned by public, such as the discretion of the Social support; whether the income and expenses of the Social support should be brought into the open; whether or not abroad illegal birth needs to pay Social support; the one-child couples is or not necessary to pay Social support. Through the above content, the writer want to eliminate the negative effect in the implementation process of Social support, and realize the justice of social.

关于社会抚养费的法律思考
引言
体育明星田亮夫妻于2012年4月19日被《人民日报》报道称在香港生了第二胎，因而遭到陕西省计生委的调查，面临着可能要缴纳几百万元的社会抚养费；以及2014年1月9号，知名导演张艺谋夫妻收到了被责令交纳7487854元社会抚养费的《社会抚养费征收决定书》。这些知名度较高的公众人物的超生事件引起了大众对社会抚养费议题的高度关注，进一步挑起了社会大众对社会抚养费的关注。
