摘  要：早在2014年11月底全国人大常委会就通过了关于修改行政诉讼法的议案，明确了一部分行政协议案件被纳入了行政诉讼的受案范围。在2015年行政诉讼法正式生效前，最高人民法院为了配套行政诉讼法适用又公布了若干司法解释，其中也不乏对行政合同诉讼的相关规定。这是自《行政诉讼法》实施二十多年来，我国正式从立法与司法两个维度构建行政合同诉讼制度。但是基于历史和现实的因素，我国行政合同诉讼一度处于混乱的局面。尽管行政合同诉讼制度已经建立，但具体的规定并没完善。本文即着眼于行政合同诉讼制度的问题，阐述其建立及其原因，对该制度进行相关检讨，最后对其完善提出自己的建议。75895

The review and perfection of the administrative contract litigation system in China

Abstract：As early as the end of 11 2014, the National People's Congress adopted a motion on the amendment of the administrative litigation law, a clear part of the administrative agreement was included in the scope of administrative proceedings。 Before the formal entry into force of the administrative litigation law in 2015, the Supreme People's court announced a number of judicial interpretations in order to apply the administrative litigation law, including the relevant provisions of the administrative contract litigation。 This is since the implementation of the administrative litigation law for more than 20 years, our country formally from the legislative and judicial two dimensions to build administrative contract litigation system。 But based on the historical and realistic factors, China's administrative contract litigation once in a chaotic situation。 Although the administrative contract litigation system has been established, but the specific provisions are not perfect。 This paper focuses on the problem of administrative contract litigation system, expounds its establishment and its reasons, the system is reviewed, and finally put forward their own proposals to improve the system。
