我国无效婚姻制度的缺陷与完善

摘要：无效婚姻制度是2001年婚姻法修正案正式确立的一项制度，是我国婚姻立法上的重大跨越，推动我国的婚姻立法更好地顺应时代潮流与世界婚姻立法接轨。但是，十几年的司法实践表明，我国的无效婚姻制度依旧是不成熟的。因此，本文从无效婚姻制度的概念、历史沿革、现行法律规定、缺陷和完善等方面进行论述，对无效婚姻的法定事由、法律程序、法律后果这三大方面进行分析，提出减少无效婚姻的适用情形，将早婚和疾病婚纳入可撤销婚姻的范围、明确规定申请确认婚姻无效的期限、区分无效婚姻和可撤销婚姻的溯及力、增设损害赔偿制度保护无过错方的合法权益等立法建议，进一步完善我国的无效婚姻制度，加快婚姻法治化进程，更好地满足新时代的需要。77484

一、引言

2001年施行的《中华人民共和国婚姻法》（以下简称《婚姻法》）新增无效婚姻的内容，首次确立无效婚姻制度，这为司法机关的审判活动提供法律依据，真正做到有法可依，不仅维护了婚姻法的威严，保障合法婚姻的稳定，还有利于化解婚姻解纷，消除违法婚姻造成的不良社会风气，促进社会健康和谐发展。随着社会的不断变化发展，无效婚姻制度在这十几年的司法实践过程中暴露诸多不足。为了保证司法实践活动正常有序进行，维护家庭的稳定、社会的和谐，有必要尽快完善这项制度。论文网我国无效婚姻制度的缺陷与完善:http://www.youerw.com/faxue/lunwen_89050.html
