摘要：污点证人作证豁免从本质上来说是一种司法交易，在打击犯罪方面有着很重要的作用，而在我国的刑事司法实践中也存在不少污点证人作证豁免的案例，但是在法律上对此却没有明文规定。本文从污点证人豁免制度的必要性出发，在考察域外污点证人豁免制度的豁免模式选择、适用案件范围以及启动程序的基础上，结合中国的现实状况，从豁免模式、适用范围、适用条件等方面构建具有中国特色的污点证人作证豁免制度。77485

上个世纪末，发生了一起严重的工程事故——重庆綦江虹桥垮塌事故，该事故造成了重大的人员伤亡和巨大的经济损失，引起了全国的关注。根据对事故发生原因的分析，专家认为这是一起人为造成的事故。在关注事故发生原因的同时，我们也关注案件的证据收集和审判过程。在案件审理的初期由于关键性证据的缺失而使案件的审理陷入困境。最后由控方将行贿人费上利变为 “污点证人”来指证被告人林世元在任职期间收受贿赂财务13余万元，才使得案件顺利完成。而行贿人费上利因为充当检察机关的“污点证人”，检察机关对其行贿行为做出了不起诉的特殊处理，而仅对工程重大安全事故罪提起公诉。由此污点证人作证豁免制度进入公众的视野，成为法学界热门的话题。文献综述  我国污点证人作证豁免制度的构建:http://www.youerw.com/faxue/lunwen_89051.html
