摘要：近年来，经济一体化、全球化、国际化迅猛发展,伴随着国际贸易中的取消数量限制和降低关税,在国际贸易领域中的知识产权问题正不断成为人们关注的热点和焦点。许多发达国家及其跨国公司利用知识产权保护其本国市场和侵占他国市场,知识产权壁垒已经成为阻碍中国对外贸易发展的主要障碍之一。本文主要阐述了知识产权壁垒的界定、特征及其表现形式,并重点介绍了中国对外贸易遭遇知识产权壁垒的原因和应对知识产权壁垒的措施，力图从不同层面解决知识产权壁垒对中国对外贸易的不利影响，从而更好的促进我国的对外贸易发展。 26107

A study of strategies to deal with barriers to foreign trade in Intellectual Property Rights
Abstract: In recent years, economic integration, globalization, the rapid development of internationalization, with the international trade in elimination of quantitative restrictions and reduce tariffs, intellectual property issues in the field of international trade are increasingly becoming the focus of attention and focus. Many developed countries and their multinational corporations use intellectual property rights to protect their own markets and occupation of his country markets, intellectual property barriers has become one of the main obstacles to hinder the development of China's foreign trade. This paper describes the definition of intellectual property barriers, features and manifestations, and highlights the causes and remedies of China's foreign trade barriers to deal with intellectual property rights of intellectual property encounter barriers, trying to resolve intellectual property rights from different levels of the Chinese foreign trade barriers adverse effects, so as to better promote China's foreign trade development.

随着经济一体化、全球化、国际化的不断发展，2013年，中国进出口贸易总额25.84万亿，增长7.6%，到2014年，中国进出口贸易总额达到了26.43万亿，增长2.3%。2014年，中国进出口贸易额占全球12.2%的比例，为世界之首。这表明，中国在国际贸易中的作用越来越重要，同时也愈来愈多地遭遇到了知识产权壁垒，如何应对知识产权壁垒已成为当前国际贸易中一道严峻的课题。
一、国际贸易中的知识产权壁垒
（一）知识产权壁垒的发生和背景
15世纪的西欧，知识产权的庇护开始逐渐发生，随后，越来越多的国家建立了保护知识产权的国家法律制度。截至目前，全球的大多数国家已经建立了相对完善的知识产权庇护系统。
但随着经济一体化、全球化、国际化趋势的不断发展，知识产权保护也不可能只是局限于一国内部，而呈现出整体化的发展趋势。自19世纪80年代，各个国家为了保护本国的经济纷纷签署了不同的国际协定或公约以寻求知识产权的国际保护。1883年11国联合签署了著名的《巴黎公约》，并按照条约要求成立了庇护产业产权联盟，这一行动成为知识产权国际庇护的发端。随后，经过不断地发展变化，知识产权的国际保护已经通过公约、协定、协议等方式建立了一系列制度。在知识产权的国际保护下，知识产权人的权利得到了一定的保护。 我国应对对外贸易中知识产权壁垒的策略研究:http://www.youerw.com/jingji/lunwen_20171.html
