Civil preservation system research
Abstract：Along with the popularization of legal knowledge in society, citizens' consciousness of maintaining their legal rights and interests increase, to claim the perfecting of the law. In the civil preservation system and civil preservation system continuously in rich now, science and technology constantly improve the procedures of civil preservation. In 2012, for example, the our country civil preservation before only prescribed by the law of property preservation, but modified for property preservation and act preservation. Through the concept of civil preservation system, historical development and its value of research can be found the flaws of the civil preservation system in our country. After analyzing these defects can help us to improve the civil preservation system. By the improvement of the civil preservation system and to perfect the civil procedure law. In civil litigation to maintain the fairness and justice of law make the legal right to get timely relief.

民事保全制度研究
前言
在国际社会中民事保全制度被大多数国际所采用，在发达的商品经济中发挥了重要作用，民事保全在民事诉讼中的地位不断提升。这就引起了很多法学家的重视，对于民事保全制度不断的深入研究，取得了丰硕的成果。大多数法学家认为民事保全是为了保护申请人的合法权益而制定出来的。这一点民事保全的诉讼结果上可以看出即合法权益得到了救济。法学家们通过对民事保全制度的研究，用精辟的语言描述出了民事保全制度的目的、价值及其存在的缺陷是民事保全制度进一步完善。
其中有不少学者的观点得到了广泛的认可。如学者江伟在《民事诉讼法专论》中提出“财产保全程序与审判程序是两种性质不同的程序，财产保全程序并非解决当事人之间的民事权利义务争议。因此财产保全的管辖法院如果完全照用审判管辖法院的规定，有时并不能达到财产保全使判决得以执行的目的。” 这种观点指出了审判程序和保全程序是不相同的，法院不能把两种程序混淆起来使用，必须加以区分适用不同的程序。这一点得到了很多的的学者一致的认可，在其后的的立法实践中得到了体现。学者王福华撰写的《民事保全制度研究》中认为“我国法院依职权采取财产保全措施是超职权主义的一种典型表现。法院如果在保全中过于主动，必然偏离司法的中立属性。要建立有效的民事保全保障体制，设立必要的上诉制度是不可或缺的内容，通过建立当事人上诉救济程序来弥补该缺陷。” 其中认为的法院应该坚守它的中立地位，不应采取主动态度去行使属于申请人的权利，而且要建立起上诉机制保护权利得到有效的救济。但是在其观点里没有关于法院依职权行使的危害进行阐述，有待于以后的学者进行研究。
