摘 要:我国《物权法》第106条对善意取得制度下的动产和不动产进行了统一规定,不动产善意取得制度最终在法律层面上得以确认。同其他国家和地区立法比较,这项对顶是善意取得制度更加完善。通过对我国立法的研究,对比国内理论界关于不动产善意取得制度的不同观点,分析确定不动产善意取得制度的必要性,以论证的方式阐述了成立不动产善意取得所需的构成要件,并就如何完善不动产善意取得制度,提出了自己的观点。 38207 毕业论文关键词:不动产;善意取得;公示公信;无权处分
On the Bona Fide Acquisition of Real Estate
Abstract :China's "property law" Article 106 on the bona fide acquisition system dynamic property and real estate for the uniform provisions, real property acquired in good faith system in legal level is confirmed. Compared with the legislation of other countries and regions,the top of the bona fide acquisition system more perfect. Through the research on the legislation of our country, compared to the domestic theoretical circles different views on the bona fide acquisition system, analysis to determine the real property acquired in good faith system of necessity, to argue on the establishment of real property acquired in good faith the required elements, and how to improve the real property acquired in good faith system, put forward their own point of view.
