On the Bona Fide Acquisition of Real Estate
Abstract :China's "property law" Article 106 on the bona fide acquisition system dynamic property and real estate for the uniform provisions, real property acquired in good faith system in legal level is confirmed. Compared with the legislation of other countries and regions,the top of the bona fide acquisition system more perfect. Through the research on the legislation of our country, compared to the domestic theoretical circles different views on the bona fide acquisition system, analysis to determine the real property acquired in good faith system of necessity, to argue on the establishment of real property acquired in good faith the required elements, and how to improve the real property acquired in good faith system, put forward their own point of view.

论不动产善意取得前言
现今理论界和列国关于不动产是否适用于善意取得这个问题各自存有看法。我国关于善意取得制度的确定是在2007年的3月份获得通过，并且在2007年10月1日正式实施的《物权法》。该法中的第106条打破了传统的民法理论中对善意取得仅适用于动产的界限，表明了不动产善意取得制度在民法的立法史上第一次得到了肯定。目前，我国对于善意取得是否适用于不动产仍然存有争议，具体有两种观点，一种是肯定说，承认不动产善意取得的合理性，也是我国物权法所确认的；一种是否定说，认为不动产登记公信力的存在，解决问题绰绰有余，不需要另外设置不动产善意取得制度。笔者以为，不动产能够适用善意取得制度。
一、我国不动产善意取得的理论分歧
现如今，我国的理论界对不动产能不能适用于善意取得依然纷争不止，主要观点有两个：
