摘 要:随着我国社会主义市场经济的不断发展,城市化进程逐渐推进,土地是城市化进程推进的重要基石。在此过程中,人们对土地进行再次开发,提高土地利用效率,由此产生增值利益,国外将之称作“土地发展权”。但我国现行法律法规中并未明确规定土地发展权,因此在土地发展过程中出现一些问题,如土地发展权立法缺失导致土地增益分配不公、土地资源配置效率低等问题。对于这些问题,我国可以规范土地发展权,对土地发展权进行立法,从法律上明确土地发展权的权利归属,有利于解决现实生活中土地发展过程中存在的问题。38893 毕业论文关键词:土地发展权;土地增益;土地发展权归属
Study on the Land Development Right
Abstract:With the continuous development of China's socialist market economy and urbanization, the land is an important cornerstone of advancing urbanization. In this process, people develop the land again and improve land use efficiency, thereby generating value-added benefits, foreign to it as "the land development rights".But China's current laws and regulations did not specify land development rights, so there are some problems in the land development process, such as the lack of land development rights legislation led to gain unfair distribution of land, land resources and low efficiency. For these problems, our country can regulate land development rights, land development rights legislation, specifically the right to ownership of land development rights from the law, help solve real life land problems in the development process.
