On the legislative protection of the copyright of network works
Abstract：With the rapid development of science and technology revolution, the people's production and life has brought great convenience, but at the same time, also has a certain impact on the traditional copyright theory, the traditional copyright law has been difficult to meet the effective protection of network works, network copyright protection problems become more and more prominent. In this paper an overview of network copyright and components are introduced on the application standard, put forward in the protection of network copyright legislation, in the process, the principle of imputation, shortcomings of the jurisdiction and so on, and further expounds how to protect the copyright of network effectively, for the sake of find a can effectively protect the copyright of network works, but also to promote the steady development of the road network technology.

论网络作品著作权的立法保护 一、网络作品著作权的概述
（一）网络作品著作权的概念
著作权是指作者对其创作的文学、艺术、和科学领域内具有独创性并能以某种有形形式复制的智力成果所享有的专有权利。[1]这里所说的作品，必须是在法律保护范围之内的作品，其次还应该具有独创性的特点，没有一定的独创性，则不能称之为作品。著作权在理论上通常有狭义的著作权和广义的著作权之分。狭义著作权是指作者对其独立创作的作品依法享有的权利；而广义著作权既包括狭义的著作权内容，还包括著作邻接权，如艺术表演者的权利、录音录像制品制作者的权利、广播电视组织的权利、图书和报刊出版者的权利等。我国《著作权法》所表达的是广义的著作权，并将著作邻接权称之为“与著作权有关的利益”。[2]
