Abstract: The legal protection system of well-known trademark in our country has experienced the production, development, mature, perfect stage. With its development is becoming more and more important meaning, the necessity of special protection to the well-known trademark is increasing. Although our country already has a relatively perfect legal protection system, the rapid development of the economy constantly appears new problems. To solve these problems, summarizing the basic concept of well-known trademark, analyzing the legal protection system of well-known trademark in China, analyzing the existing problems and reasons. Thus solving the problem of well-known trademark in China radically, helping and improving the socialist legal system civilization, promoting the development of economy friendly and harmonious.

浅析我国驰名商标的法律保护前言
“驰名商标”又称为周知商标，含义是指在中国享有较高声誉并为相关公众广为知晓的商标。我国从加入《保护工业产权巴黎公约》到现在已有30多年，到今天已经确立了一个相对完整的驰名商标法律制度。回溯我国驰名商标法律制度的发展历史，显现的是一个漫长曲折的过程。在这发展过程中，我们曾一度迷失在因制度缺陷而引起的以行政为手段对驰名商标形成“申请认定、批量认定、批量公布”的模式，并愈演愈烈，对我国驰名商标的发展造成了严重影响。直到本世纪初叶，经过《商标法》的第二次修改，我们才终于逐步走到了现在的“个案认定、被动保护”为原则的驰名商标保护制度中，并在短短的十几年内取得了飞速的发展。为我国驰名商标保护作出了不可磨灭的贡献。
然而我们还没来的急为自己的胜利欢呼，“三鹿”三氯氰胺事件就像一枚重磅炸弹一样在我们的身边响起，紧接着“同仁堂”农药残留事件、“霸王”洗发水致癌事件、“原阳”大米造假事件就像雨后春竹一样出现在我们的视野。是什么让我们一直信任的中国驰名商标出现了这么大的问题？中国的驰名商标是怎
