摘要：军人婚姻法律的保护在我国现今仍然具有着重要的意义，他起到着稳定军心、维护 国家长治久安的作用，同时对于个人来说也是对于军人这一群体的保护也有着重大的意 义。但是在承认其价值的同时我们又不能否认其存在的一些弊端。其中有一些法律条文已 经跟不上时代的发展，另外有一些条文是对军人的过度保护违反了权利义务一致的原则以 及限制了公民的自由权同时还存在着保护主体的不公平性等问题。当然针对其存在的问题 我们可以从多方面解决，比如提高军人的待遇以地位，或者放宽随军条件等等。这样或许 对军人的保护会更加合理。70743

前言

在我国现行婚姻法中军婚受到特殊的保护乃是众所周知的事情，并且运行了多年，但 是随着社会的发展，现行婚姻法中对于军人的保护是否还会继续适合现状？2001 年至今运 行的婚姻法虽然仍然保留对于军婚的保护，但是但书的增加使得我们又要重新思考是否仅 仅依靠这个但书就能掩饰军人婚姻法律保护的弊端？是否这样就能够充分保护军人的配 偶的权益？

一 军婚法律保护的制度内涵及意义论文网

（一）军婚的定义

军婚是夫妻双方或一方是现役军人的婚姻关系。现役军人是指正在中国人民解放军或 人民武装警察部队服役、具有军籍的人员。退役军人、复员军人、转业军人和军事单位中 不具有军籍的职工，均为非现役军人，其婚姻关系均不能按军婚办理。现役军人的婚姻受 国家法律的特别保护，法律对军婚的结婚、离婚等问题均有特别规定。 我们从条文中可以看出军婚的一方必须是现役军人，而不能是其他人，所以对于军婚是有 了明确的定义的。
