摘要:伴随着学校教学的进一步扩展,大学生自我要求的实现和实习经验的重要性,实习已经成为各年级大学生的主流趋势,这也使大学生实习在各个阶段有多重法律身份,但是从我国现行的法律很难找到对于大学生身份的认定区分和相应的保护,相关的法律出现空缺或者误区,甚至由于发布间隔时间长,有些法律显得有年代感,立法的合理性显然不适合当代,这直接导致实习生的合法权益受到侵害后,不能很好的用法律作为武器去维权。本文从不同实习身份大学生的劳动保障范围为前提,通过研究主要讨论劳动权利受损的相关法律缺失、实习各协议的规范性和实习报酬的税金问题,最后从政策、高校、用人单位、社会各方和实习生自身等方面出发给出对策和创新的模式,从而构建一个合法全面多样化的大学生实习权益保护体系。80543

Research on the Protection of Labor Rights and Interests of the Students during the Internship
Abstract:With the further expansion of school teaching, the importance of college students' self-demand and practice experience,internship has became the main trend of all grades of college students, which also makes the college students practice in various of legal status。But from our current law it is difficult to find the identification of college students and the labor security, the relevant legal vacancies or misunderstanding, and even because of the release of a long time, some laws seem chronological, legislative rationality is not suitable for contemporary, which directly forced the interns in their legitimate rights and interests have been infringed, can not be good with the law as a weapon to defend。 This thesis discuss the variety of internship status of labor protection is different, through the labor rights damage related to the lack of relevant laws, practice the normative and internship compensation tax Finally,from the aspects of policy, colleges, employing units, social parties and interns themselves, try to build a lawful and comprehensive persity of college students internship protection system。
