21世纪我们进入高速发展时代，企业经济决定了国家的经济基础，是经济命脉，是市场经济的重要组成部分，企业的专利管理地位变得格外重要。但是我国目前大部分企业在专利管理方面存在这样或那样的问题，专利意识不足，缺乏专利管理机构和人才，专利转化率和利用率低下，维权意识差。在这样的背景基础下，论文以企业专利管理模式作为研究对象，并结合企业专专利管理理论为指南，通过文献研究、案例实证法等手段对企业专利管理模式进行调查述总。 通过这些企业专利管理模式特点带给我们国内企业的一些启示，就我国如何进行专利管理给出一些建议。论文由四个部分组成，第一部分阐述了论述了研究背景、研究意义以及论文的基本思路。第二部分是相关理论的介绍，主要包括企业专利管理理论等，专利、知识产权以及专利管理的定义、地位、作用。第三部分通过文献调查研究、逻辑分析、实例论证等方式来对各类企业专利管理模式进行分类。第四部分根据我国企业专利管理的现状，存在的典型问题，给出提升我国企业专利管理的建议。42026

Title The Survey on Patent Management Mode ofEnterprises
Abstract In twenty-first Century we have entered the era of rapid development, the enterpriseeconomy determines the economic base of the country, is the lifeblood of the economy, is animportant part of market economy, enterprise patent management status has become particularlyimportant. But at present most of the enterprises in patent management exists this or thatproblem, lack of awareness of the lack of patent, patent management agencies and personnel thepatent, conversion rate and low utilization rate, lack of awareness of rights protection. In thisbackground, this paper takes the enterprise patent management model as the research object,combined with the enterprise patent management theory as the guide, through literature research,case investigation method means the enterprise patent management mode through thecharacteristics of patent management mode. These enterprises bring some enlightenment of ourdomestic enterprises in our country, how to carry out the patent management and give somesuggestions. The thesis consists of four parts of an article. Part of the thesis, describes theresearch background, research significance and the research route. The second part is theory isintroduced, mainly including enterprise patent management theory, patent, intellectual propertyrights and patent management definition, status and role. The third part through literature study,logical analysis and case studies to classify all kinds of enterprises patent management mode.The fourth part according to the present situation of our country enterprise's patent management,the typical problems of, is given to enhance the our country enterprise's patent managementadvice.

1 绪论
1.1 研究背景随着知识产权战略提升到一个新的高度，专利已经逐渐成为企业竞争的重要资源，能够体现出一个国家、地区、城市和企业核心竞争力。现代企业竞争优势的强弱和可持续发展的能力很大程度上取决于企业是否对专利资源进行了有效管理。 改革开放以来,虽然我国的高新技术企业数量持续快速的增长，我国专利的申请量以年均 15%的速度增长，但是我国企业的专利管理现状却十分令人堪忧，知识产权意识不足。据国家知识产权局的不完全统计， “863”计划仅仅只有五分之一的成果申请了专利，但发表论文却很多，论文和专利比例约为 80：1，很多发明创造因为相关论文的发表使之丧失了被授予专利的条件，让很多本应该应用于市场的产品都未能出现，这其中研发成本的损失以及市场收益是不可估量，企业没有很强专利保护意识。很多重要产业中自主研发的专利本来就少,即使是这样的条件下，仍有一大部分成果并没有被使用,只是将研究停留在实验室中，缺乏了市场的检验。根据中国知识产权总局的有关调查,发达国家的平均专利转化率为 60%,日本和美国的专利转化率达到 70%至 80%,而我国企业的专利转化率约为40%,我们国家相比发达国家有相当大的差距， 不仅专利的利用率很低，同时专利转化率也是低的可怜。
