摘    要家庭暴力作为国际热点问题，在我国也普遍存在，针对我国的家庭暴力问题，多年来一直没有专门的法律来防治，2016年3月1日正式施行的《中华人民共和国反家庭暴力法》为正在遭受家庭暴力的受害人带来了一线曙光，其中的人身安全保护令制度是非常重要的一项手段，但是由于法规还较为笼统，缺乏具体的操作指南，在家庭暴力案件中的适用上还存在一些问题急待解决。本文将分析我国现有的人身安全保护令制度存在的不足，借鉴域外的经验，为完善人身安全保护令制度提供一些建议。论文主体分为五个部分，第一部分介绍人身安全保护令制度的概况，介绍其含义，历史渊源和意义；第二部分比较借鉴了域外关于人身安全保护令制度的经验和教训，为完善人安全保护令制度提供一些启示；第三部分分析了我国现有的人身安全保护令制度在立法和司法上的实践问题，介绍了人身安全保护令制度的沿革；第四部分总结了我国人安全保护令制度存在的不足；第五部分是关于如何完善我国的人身安全保护令制度，为防治家庭暴力提供一些助力。88358
