摘    要互联网飞速发展，网络经济不断崛起，随着互联网企业的竞争加剧，互联网不正当竞争行为随之产生。除传统不正当竞争行为在互联网环境下的延伸外滋生了多类新型行为，对我国网络经济的健康、和谐、有序发展造成了极大的威胁。同时，现有的法律体系不足以对互联网环境下的不正当竞争行为进行全面、有效规制。本文对现存互联网不正当竞争行为的表现形式进行类型化归纳总结，阐述了互联网不正当竞争行为的违法性认定因素，借鉴国外发达国家的有益经验，从立法、司法、执法、其他四大方面为完善互联网环境下反不正当法律制度提出建议。88451

Abstract   With the rapid development of the Internet, cybereconomy has risen sharply。 Along with the intensifying competition of Internet companies, acts of unfair competition come into being。 In addition to the traditional acts of unfair competition which extends in the internet environment, new types of behavior have been created。 The new manifestations are great threats for China’s healthy, harmonious and orderly development of cybereconomy。 Meanwhile, the existing legal system is not enough to regulate acts of unfair competition under the Internet environment comprehensively and effectively。 This paper has concluded the manifestations which exists at present。 It has also expounded the elements which determine the illegality of the acts of unfair competition under the Internet environment。 In order to perfect the acts of anti-unfair competition’s legal regulations, this paper offered proposals from four aspects which consist of legislation, judicature, law enforcement and others, based on the beneficial experience of foreign developed countries。
