论行政诉讼变更判决制度

摘要行政诉讼变更判决制度是行政诉讼中一项重要的制度，自其确立以来在理论与实践的检验下不断发展完善，对我国行政诉讼法产生了举足轻重的影响。尽管2014年修订的行政诉讼法增加了变更判决制度的“行政行为涉及对款额的确定、认定确有错误”适用情形，但是行政变更判决在我国适用率低、适用范围狭窄仍然影响其特有功能的发挥。文章通过对域外相关立法和我国的实施现状的剖析，提出了提高变更判决的适用率、扩大变更判决的适用范围和明确“明显不当”的概念等相关建议，以期完善我国的行政诉讼变更判决制度。89440
