摘  要：随着网络和信息技术的发展，人类迅速并全面的进入了网络时代。在信息化时代，网络与个体权益、社会秩序、公共安全乃至国家安全紧密联系。在“全球公域理论”与“领网主权”之争中，我国明确肯定领网主权的存在。对于国家主权与领网主权的要件分析中，国家主权与领网主权存在相似之处。同时肯定国家主权中的原则同等适用于国家领网主权。领网主权与国家经济、社会稳定和国家安全紧密相关，其一旦受到破坏，便会带来意想不到的损害。93088
