摘 要：现阶段，我国医患关系的紧张程度日益加剧，医患之间信任不足，医患纠纷如何妥善解决备受患者以及社会各方面的关注，本文从温岭杀医案引入分析医患纠纷解决程序中的正当性因素缺失，进而分析医患纠纷解决程序中的非正当性因素，由非正当性因素切入深入阐述非正当因素的形成原因及其危害，通过对美国、日本医患纠纷立法例的例举重点分析医患纠纷解决程序中的正当性要素及处理医患纠纷的有关法律，最后提出完善我国医患纠纷解决程序的建议。93472

一、引言
近年来,医患纠纷愈演愈烈,经常登上各大新闻媒体的头条,医患之间互相不信任,矛盾日益恶化,到底该如何有效的处理医患纠纷呢？靠医方、患方自行协商处理医疗纠纷有时候会有失公平,实践发现其已不能成为有效的解决医患矛盾。届时，司法途径、第三方调解机制等成为新的选择。医患纠纷已经成为中国社会一个不容忽视的不稳定因素,寻求正当的解决机制不容忽视。医患纠纷的解决程序具有一定的流程,其中的正当性要素是现代医患关系进步所必须的。
2013年十月二十五日上午八点，温岭市的第一人民医院发生了一起病患用刀捅杀医生的严重犯罪案件案件，这名男子将三名正在为急诊病人看病的医生捅伤，其中有一位医生因抢救无效而死亡了，这位医生就是该男子的主治医师--耳鼻喉科医生王云杰。2013年十月三十一日，在温岭殡仪馆举行了被杀害耳鼻喉科医生王云杰的葬礼。2014年一月二十七日，杀人犯连恩青终于被判刑，被判死刑和剥夺政治权利终生。2015年五月二十五日，犯罪嫌疑人被执行枪决。 论医患纠纷解决程序中的正当性要素:http://www.youerw.com/faxue/lunwen_201312.html
