摘要：军人婚姻法律的保护在我国现今仍然具有着重要的意义，他起到着稳定军心、维护 国家长治久安的作用，同时对于个人来说也是对于军人这一群体的保护也有着重大的意 义。但是在承认其价值的同时我们又不能否认其存在的一些弊端。其中有一些法律条文已 经跟不上时代的发展，另外有一些条文是对军人的过度保护违反了权利义务一致的原则以 及限制了公民的自由权同时还存在着保护主体的不公平性等问题。当然针对其存在的问题 我们可以从多方面解决，比如提高军人的待遇以地位，或者放宽随军条件等等。这样或许 对军人的保护会更加合理。70743

在我国现行婚姻法中军婚受到特殊的保护乃是众所周知的事情，并且运行了多年，但 是随着社会的发展，现行婚姻法中对于军人的保护是否还会继续适合现状？2001 年至今运 行的婚姻法虽然仍然保留对于军婚的保护，但是但书的增加使得我们又要重新思考是否仅 仅依靠这个但书就能掩饰军人婚姻法律保护的弊端？是否这样就能够充分保护军人的配 偶的权益？

（一）军婚的定义
