摘要在进入21世纪之后，信息技术开始向社会各个领域进一步的渗透，成为了改善人类生存与推动社会进步的强大助力。技术的革新发展需要一定的制度基础，尤其是需要规范的法律制度的保护，而法律制度也需要在新的技术的变革中创新与发展。“网络虚拟财产”是由电子信息技术所引发的一种新产生的事物，这种新产生的事物让传统的法律法规有些不知所措：网络虚拟财产是否为传统民法意义上的财产呢?网络虚拟财产有着什么样的法律属性？这是传统的财产法律制度必须给出答案的问题，也是解决对网络虚拟财产现在的法律如何进行保护首先应解决的问题。为了解决这些问题，我们需要对网络虚拟财产的概念与特性重新进行界定,并且对网络虚拟财产的法律属性做出明确而清晰的回答，进而摸索出一种保护这种新产生的事物的法律解决办法。10019

Abstract
After entering the 21st century, information technology to all areas of society further infiltration has become a powerful help to improve human survival and to promote social progress. The basis of technology innovation system, in particular the need to standardize the protection of the legal system, legal system in the change of new technology innovation and development. “Virtual property” is caused by electronic information technology, the new things so that the traditional laws and regulations to know what to do: Virtual property for the traditional civil law on the property? The virtual property has what kind of legal property? 1 引言
2003年北京市朝阳区人民法院审理河北省承德网络游戏《红月》玩家李宏晨诉北京北极冰科技公司一案。原告李宏晨在登录网络游戏《红月》时，发现其价值2000多元人民币的虚拟生化装备全部丢失，查询后得知装备被转移到一个叫shuiliu0011的ID上，在和游戏的运营商北京北极冰科技公司协商无果之后，遂一纸诉状告上法庭。此案被认为中国“虚拟网络财产”第一案。至此，“网络虚拟财产”一词走进我国司法视野，此后全国各地都陆续出现了涉及到“网络虚拟财产”的案件。
