摘 要：上海自由贸易区于2013年9月29日由国务院批复建立，上海自贸区的成立为我国带来空前绝后的活力。上海自贸区的发展离不开金融的创新，随着金融创新活动的进行伴随而来的是不可忽略的风险。金融创新的顺利开展必须要有较为体系与完善的法律法规作为保障，我国现有的金融法律法规不能最大程度上保护金融创新的开展，甚至还会缩减上海自贸区金融可创新的空间。所以此时急需颁布一批新的金融法律法规或进行一次金融法律改革来确保上海自贸区金融创新任务的实现。94364

Research on the legal issues of financial innovation in the FTA——A case study of Shanghai Free Trade Zone 

Abstract：Shanghai free trade zone was established in September 29, 2013 by the State Council approved the establishment of the Shanghai free trade area in China has brought unprecedented vitality。Shanghai free trade zone is inseparable from the development of financial innovation, along with the financial innovation activities accompanied by the risk can not be ignored。 Financial innovation is carried out smoothly must have more system and perfect laws and regulations as a guarantee, our existing financial laws and regulations can not maximize the protection of financial innovation, or even reduce the Shanghai FTA financial innovation space。 So it is urgent to enact a number of new financial laws and regulations or a financial legal reform to ensure the realization of the Shanghai Free Trade Zone financial innovation tasks。

    上海自贸区全称中国（上海）自由贸易试验区，成立于2013年9月29日，共分为七块区域，分别为上海市外高桥保税区、外高桥保税物流园区、洋山保税港区和上海浦东机场综合保税区、金桥出口加工区、张江高科技园区和陆家嘴金融贸易区，至2014年12月共占地约120。72平方公里。
