摘要现代社会是网络信息的时代，随着自媒体时代的到来人们在参与网络信息的传播过程中逐渐从被动接受转变成为信息的主动传播者，人们在享受着网络带来的便捷之外，也承受着其带来的不同程度上的危害，网络平台的隐形性，快捷性，广泛性使得网络谣言似病毒般传播。网络谣言在本质上是一种未经证实的虚假信息，借助网络平台的开放性和交互性使得网络谣言传播更广泛，危害更大，其不仅是对公民个人名誉权、隐私权的侵害，更是对社会秩序，国家形象甚至整个人类社会的一场灾难。我国现行法对网络谣言的规制存在立法体系不完善、行为界定不清晰、执法力度不强以及责任制度不明确等问题，要行之有效的治理网络谣言，就要依靠完备的法律法规，同时提高执法力度加强网络监管，建立信息公开化制度从而更好的防治网络谣言。87717

Title    The legal regulation of the Internet rumors             

Abstract Modern society is the era of network information, with the advent of the era of the media ,the role of the people who used to participate in the transmission of network information gradually shifts from passively receiver to the disseminator of information, people enjoy the convenience brought by the network , meanwhile they are also exposed to the harm of different degree , the characteristics of network platform just like invisibility, immediacy, universality make Internet rumors spread like virus。 In essence，Internet rumors is a kind of unsubstantiated false information, with the help of the network platform’s openness and interactivity , Internet rumors spread more widely and more harmfully, not only is it the infringement of citizens' personal reputation, right of privacy, but also it impacts on the social order, national image and is even like a disaster to the whole human society 。 Nowadays，the main problems of our current legislation system are listed bellow：the regulation of Internet rumors is incomplete, the behavior definition is not clear, law enforcement is not strong。Problems such as unclear responsibility system to effective governance network rumors are still exist, the solution of the problems will depend on the perfecting of laws and regulations, improvement of law enforcement and strengthening the network supervision at the same time, furthermore，building a more open system of information is also necessary，so that we can prevent and govern the Internet rumors more properly。
