摘要行政立法作为我国立法活动的重要组成部分，对我国法制建设有着重大影响，行政立法活动的合法性与科学性直接影响我国社会生活的方方面面。随着生产力的提高以及社会现实的需要，行政立法活动已经广泛存在。但行政立法作为一种新的立法体系存在时间短，并且传统的三权分立学说并没有对行政立法作出解释，因此行政立法权的民主正当性受到了广泛讨论。而公众参与机制作为行政立法的补强手段，对调节行政立法法程序中因行政运行机制与行政立法的民主性要求而产生的对立关系起到了不可或缺的作用，是行政立法正当性和行政立法实效性的理论依据与强化手段。本文将立足于行政立法程序中的公众参与相关基础理论，广泛分析国内外行政立法程序中的公众参与制度，阐述公众参与制度对于当今行政立法在理论上与现实中的的必要性与重要性，并提出完善我国公众参与制度建设的意见。87764

Abstract As an important part of China's legislative activities, administrative legislation has a significant impact on the legal construction of our country, the legitimacy and the scientific nature of administrative legislation directly affect all aspects of social life。 With the improvement of productivity and the need of social reality, the administrative legislation has been widely existed。 But as a new legislative system, administrative legislation has a short time, and the traditional theory of separation of the three powers does not make an explanation to the administrative legislation, so the democratic legitimacy of the administrative legislative power has been widely discussed。 And public participation mechanism as administrative legislation reinforcing way and the procedure of administrative legislation regulation according to the request of the democracy of administrative legislation and the administrative operation mechanism of antagonistic relationship to an indispensable role, is the administrative legislation right and administrative legislation effectiveness of theory basis and means of strengthening。 Based on the procedure of administrative legislation public participation in relevant theory, extensive analysis at home and abroad in the procedure of administrative legislation system of public participation, expatiated public participation system in administrative legislation at present in theory and the reality of the necessity and importance, and put forward good our public participation system construction of opinions。
