Disputes and Countermeasures of China's performing arts contract
Abstract:In recent years, culture and entertainment industry has been paid more and more attention, but because of the Performing Arts brokerage industry in China be congenitally deficient and acquired deformity makes internal performing brokerage market is very chaotic, the frequent occurrence of performing contract dispute such as bamboo shoots after a spring rain. Most of these disputes and the lifting of the contract, the reason is that the performance brokerage contract is not standardized,performing brokerage industry was not standardized and there aredifferent degrees of breach of contract. In view of the existing disputeputs forward normative performing brokerage contract specification,performing brokerage market and artist broker countermeasures to improve personal accomplishment, hoping to be able to reduce and prevent the occurrence of performing contract dispute, make the culture and entertainment industry in China the positive and healthy development.

前言
目前我国演艺合同纠纷频繁发生，如胡歌因习惯性推片约遭冷遇、林更新因私自接戏遭雪藏、张靓颖、周笔畅、尚雯婕、何洁和陈楚生先后与天娱纷纷解约等，一面是艺人控诉经纪公司只顾个人利益唯利是图，一面是经纪公司抱怨花费大力气栽培的艺人飞上高枝“有奶就是娘”。等到发生具体的纠纷时这才发现原来在法律上它存在着许多漏洞，致使双方的权益都无法得到完全保障。
一、我国演艺合同的纠纷根源
明星和经纪人本是鱼和水的密切关系，首先是艺人拥有了不同于其他人的形象气质和条件，而演艺经纪公司认为艺人的这种条件正好符合其利益发展的需要，于是双方通过协商建立合作关系[1]。倘若没有经纪公司的培训安排，艺人不可能凭自己的能力妥善处理好所有的事务，也不容易争取到演出机会；如果经纪公司不能有效地约束和管理艺人也无法从中得到合理的回报。其中艺人关心的是演艺事业的发展和报酬是否合理，而经纪公司重视的是在艺人身上的投资能否获得最大的回报。二者本是一荣俱荣一损俱损的关系，但层出不穷的演艺纠纷开始让人们怀疑这鱼水情究竟是“水助鱼”还是“水煮鱼”，那又是什么使昔日亲密无间的战友成为分道扬镳的陌路呢？
