论收容教育制度的存废

摘要收容教育制度是我国打击卖淫嫖娼的重要措施，形成于改革开放取得初步成就的特定历史时期，但收容教育的存废一直具有争议。伴随法治和人权保障的进步与发展，我国的社会主义法制建设进入了深层次的改革阶段，作为与收容教育性质相似的收容遣送、收容审查、劳动教养等制度已被陆续废止。收容教育这一原本不为不被公众所了解的制度也瞬间引起热议。结合收容教育的历史变迁与相关规定，基于我国现阶段的法制实际状况进行反思，收容教育违背法律保留原则，存在诸如责任配置失衡、执法标准模糊等比较严重的问题。因此，收容教育制度理应予以废止。在废止之后，应当提出替代措施来规制卖淫嫖娼行为。87835

Title Abolishing or Continuing: Study on The Detaining Education System

AbstractDetaining education system, formed in specific historical period of early implementation of reform and opening up policy, is a key measure for China to crack down prostitution, but the debate over the abolish is pending。 With the progress and development of rule of law and protection of human rights, socialist legal construction of China has entered the phase of profound reform, as systems like asylum and deportation, sheltering for investigation and reeducation-through-labor in similar nature with detaining education system have been abolished in succession。 Detaining education system, a former unfamiliar system for the public, has become a focus of discussion now。 In considering actual situation of current legal system of China, based on reviewing historical change and relevant regulations of detaining education system, we can know severe problems like violated the principle of legal restraint procedure and unbalanced responsibilities allocation existing in detaining education system, which shall be abolished。 After the abolishing, the system shall be replaced by alternative measures。
