我国国家赔偿的精神损害赔偿范围与标准

摘要随着我国社会经济的持续高速发展，人们对精神权利价值的关注，国家对于精神损害的赔偿也越发重视。2012年我国新修改的《国家赔偿法》明确的将“精神损害赔偿”载入其中。但在我国，国家赔偿的精神损害赔偿建立的时间较晚，大多为原则性规定，存在具体指向不明确，赔偿数额的界限不清晰，适用标准不明确，赔偿标准未确定，赔偿范围过窄等赔偿标准问题。在案件的处理中，审理法官的自由裁量性较大，处理结果差异较为明显。本文通过与美国精神损害赔偿制度的对比对我国国家赔偿法中的精神损害赔偿标准提出了进一步的完善意见。88551

Abstract With the rapid development of social economy in our country people are more and more concerned about the value of spiritual rights。 As government also pay more attention to the compensation for spiritual damage。 In 2012, China's newly revised "State Compensation Law" clearly "compensation for mental damage" in the load period。 However in China, spiritual damage of the state compensation for the establishment of the late, mostly provides for the principle, there specific point is not clear, boundaries of the amount of compensation is not clear, applicable standard is not clear, compensation standard is not determined, the scope of compensation is too narrow compensation standards。 In the judgment of the case, the trial judge's discretion is larger, the difference is more obvious。 In this paper, the writer put forward the further improvement of the standard of mental damage compensation in our country by comparing with the spirit of the United States。

我国国家赔偿制度的雏形形成于新中国初期，自1982年宪法规定依法可以获得国家赔偿的权利后，民法通则，行政诉讼法和治安管理条例等从不同方面对国家赔偿进行了规定。随着我国民主政治建设的高速发展，为了适应社会发展所产生的现实要求，进而制定了国家赔偿法。《中华人民共和国国家赔偿法》于1994年5月12日第八届全国人民代表大会通过，该法第2条明确规定了受害人可遵照本法寻求国家赔偿的权利。其中国家赔偿法中规定的赔偿义务机关，应当依照本法及时履行赔偿义务。国家赔偿法的产生和确立对于保障公民、法人和其他组织依法取得国家赔偿的权利，促进和监督国家机关及其工作人员依法行使职权具有极其重要的意义，是社会主义民主法治的突出表现，是国家法制化建设的一大进步。我国国家赔偿的精神损害赔偿范围与标准:http://www.youerw.com/faxue/lunwen_163865.html
