论我国技术侦查制度的法律完善

摘要：技术侦查因其独特性，在社会经济和科学技术高速发展的今天，被广泛应用于犯罪侦查过程中。为了实现技术侦查的法治化，我国通过了新刑诉法，正式将“技术侦查”编写入内。并对有关审批期限等作出了规定。本文首先分析了我国目前技术侦查的现状和有关法律规定内容，其次推测了我国技术侦查制度在司法实践中的不足，最后有针对性的提出相对的我国技术侦查法律制度的构想。92089

On the Legal Perfection of China 's Technical Investigation System

Abstract: Technology investigation because of its unique, in the socio-economic and scientific and technological development of today, is widely used in criminal investigation process。 China adopted a new criminal law, the "technical investigation" formally written。 And the relevant types of technical investigation, procedures, applicable conditions and scope, the approval period and so made the provisions。 This paper first analyzes the current situation of China's current technical investigation and the contents of the relevant laws and regulations, and then speculates that China's technology investigation system in the judicial practice of the shortcomings, and finally put forward the relative improvement of the technical investigation system and the technical investigation of China's laws System in order to achieve the balance of crime and the protection of human rights。

为了在惩罚犯罪和保障人权中得到平衡，《刑诉修正案》在2012年第十届全国人大第五次会议上通过了《新刑诉法》，其中新增添了有关技术侦查的内容。这项重要举措具有重大意义，为技术侦查活动正名并指明了方向，对社会经济的发展大有益处。但是随着现代经济和科学技术的高速发展，现代社会已经全面进入了信息化时代，同时出现了各式各样的新型犯罪活动和手段。技术侦查由于立法的不完善，其在实践适用中存在着许多亟待解决的问题。《刑诉修正案》对很多事项都没有具体规定，概念模糊，范围狭窄，程序不清，证据使用混乱，这些都容易导致对技术侦查的滥用，为了保护公民的权利，更好的通过技术侦查解决犯罪问题，我们需要进一步的修正其立法制度，使技术侦查在司法实践中充分发挥效果。论我国技术侦查制度的法律完善:http://www.youerw.com/faxue/lunwen_199691.html
