摘要现如今我国随着汽车行业的发展,预约出租车行业也在不断的发展,这种新兴的经营模式应市场的需求而生，也存在着一定风险。所涉多方的法律关系若缺乏有效的监管，各方法律主体的合法权益都无法得到保障。通过分析几类主体之间的多重法律关系、比较国内外的出租车规制的不同以及我国出租车行业在强制缔约方面的缺陷，分析研究得到了以下的规制办法：一是健全相关法律制度，即统一网络预约出租车的服务设施标准、明确租车发票开具义务、完善违约责任制度；二是以保障合同自由选择权和设立网络平台的强制缔约来防范运行的风险；三是构建网络预约出租车行业管理法律标准，即借鉴美国网络预约出租车管理模式、建立竞争性行业管理标准、鼓励行业自律、建立健全诚实信用机制、科学地设立价格协商制度。87837
