摘要近年来，离婚诉讼中虚假借贷的案件频发，通常表现为借贷关系是否真实存在、债务是否用于夫妻共同生活。为更了解实践中对离婚诉讼中虚假借贷的审查，笔者从裁判文书网下载了近5年全国各省市婚姻家庭纠纷中关于离婚诉讼中虚假借贷的裁判文书共308份，通过整理分析、归纳总结得出实务中对离婚诉讼中虚假借贷的审查存在借贷关系真实性审查不足、证据不足、举证责任欠缺、经验法则固有缺陷等问题，应提高对借贷证据真实性审查的标准、提高证明借贷证据的充分性标准、合理调整举证分配责任、规范经验法则主观随意性的审查等措施规制离婚诉讼中虚假借贷案件的频发现象。89778
