摘   要 近些年来，随着我国现代化进程加快，国家对于知识产权尤其是专利权的保护达到一个新的高度，我国专利制度也已经逐渐与世界接轨，趋近于完善。我国的专利制度是适应国际化发展的需求下而建立的，现有专利制度、法律法规以及实务研究的重心在于专利权利的确认和保护，而对于专利权进入市场发挥其流通作用的研究却比较少。在当前知识经济时代和资本化时代下，专利权通过专利权利质押融资转化使用专利权的价值是必然趋势。企业作为专利发明应用的主体，在发展过程中需要将创造的专利权在不丧失专利权的情况下通过权利质押获得资金融通，而目前在拥有较多专利的科技型的企业公司并不能较好的利用其掌握的专利，在许可、转让、及自用开发手段下无法全面的利用好专利权的价值，推动专利权通过质押融资，可以解决企业最迫切需要的融资担保问题。90266

因此，本文通过梳理专利权质押的理论，对专利权质押的相关问题做了一些理论制度探讨。
