人大代表参与地方立法的现状及其制度完善——以镇江为例

摘要2015年《立法法》的修改使设区的市有获得地方立法权的可能，进一步突显地方立法在法治工作中的重要性。发挥人大代表在地方立法中的作用，对于践行宪法法律精神，保证立法的科学性与民主性具有重要意义。仅以镇江市获得地方立法权为契机，对镇江市人大代表参与地方立法的现状进行实证调研，查找问题，分析原因，提出进一步加强对人大代表参与地方立法工作的领导、正确认识人大代表与代表大会及人大常委会之间的关系、解决兼职人大代表困境、保障人大代表履职的制度建设、充分发挥人大代表的主观能动性等建议，以促进地方立法制度的进一步完善。86569

On the Present Situation and the Improvement of Law-making Syetem of the NPC Deputies in the Local Legislation —Taking ZhenJiang as an Example

Abstract    The modification of the legislative law in 2015 has made the city having the possibility to obtain the local legislative power, and further highlights the importance of the local legislation in the process of the rule of law。 Playing the role of deputies in the local legislation has important meaning to practice the spirit of constitutional law, and to ensure scientific and democratic legislation。 With the opportunity of ZhenJiang city get the local legislative power, this paper studies empirically the present situation of the ZhenJiang NPC Deputies in the local legislation, and finds the problems, analyzes the reasons and puts forward some proposals that further strengthen the leadership of the party to the NPC Deputies in the local legislation, correctly understand the relationship among the NPC Deputies, the NPC and the NPC Standing Committee, solve the plight of part-time deputies, ensure the institutional construction of resumption of NPC Deputies and fully exerts the subjective initiative of the NPC Deputies to promote the further improvement of the local law-making system。
