摘 要：中国工会运动产生于近现代，工会的发展起步较国外发达国家工会的产生相对迟 缓国工会是由工人阶级自发组建的群众性组织，目的是为了保护职工的合法权益。现今我 国工会出现了一些突出问题，如企事业单位阻碍工会的组建、职工合法权益受到侵害时工 会不作为等。这些问题引发了大量的劳动争议，解决难度较大，因此工会的作用就显得举 足轻重。文章除了引言和结论，分为以下四个部分：70750

第一部分笔者从三个方面介绍了工会法律制度的一般理论。首先谈到了工会及工会法 律制度的含义。然后介绍我国工会的三个特点。

第二部分笔者分别从体系、内容、组织和相关人员保护四个方面谈到我国现行工会法 律制度的不足之处。

第三部分笔者通过查阅相关资料介绍分析了美国和日本有关工会法律制度的不同内 容，并对它们进行了简要的分析评价。

第四部分笔者通过前面对我国工会法律制度存在的问题的具体分析，借鉴国外先进工 会法律制度的经验，为我国工会法律制度改革提些建议。
