摘 要： 高通公司知识产权反垄断案引起了社会各界的广泛关注，其中所折射的知识产权滥用的问题更是引发热议。知识产权的垄断性特征使其与反垄断法存在着复杂的关系，如何处理好知识产权和反垄断的关系，完善对知识产权滥用的反垄断规制，是我国当前面临的一个难题。尽管我国《反垄断法》涉及到了知识产权滥用的问题，但是仍缺乏系统的反垄断规制，因此，只有结合对高通案的思考，通过对我国知识产权滥用反垄断规制的不断研究，才能探寻出适合我国的知识产权滥用反垄断规则。71550

On the rule of China's anti-monopoly law on abuse of intellectual property rights -- Based on the Qualcomm Corp's antitrust case

Abstract: Qualcomm Corp intellectual property antitrust case has aroused widespread concern in all sectors of the community, which reflects the issue of intellectual property abuse is a hot topic. Intellectual property monopoly characteristic of the exits complex relationships and anti monopoly law, how to deal with the relationship between the intellectual property rights and antitrust and perfect for antitrust regulation of the abuse of intellectual property rights, is a problem of the current in our country. Although our country "antimonopoly law" involving the abuse of intellectual property rights question, but still lack of system of antitrust regulations. Therefore, only the combination of thinking on the case of Qualcomm, through continuous research on the anti-monopoly regulation of the abuse of intellectual property rights of China, in order to explore the suitable for China's intellectual property abuse antitrust rules.

一、引言：问题的提出

近年来，知识产权权利人滥用权利，谋取市场垄断地位，获得不正当巨额利润的现象时有发生。知识产权本身作为合法垄断权，为反垄断法条款的豁免或者例外。虽然此种垄断会造成一定程度上的排除竞争者，降低市场竞争激烈度的影响，但这些应该视为国家为保护智力创造者利益，激励创新热情的必要代价，因此需要在保护创新和保护市场竞争秩序二者中寻求平衡点。然而，知识产权保护的目的在于促进经济发展，维护社会公益，如果违背了这一目的，那就失去了保护的意义和作用，会带来与立法目的相悖的后果，这种情况就必须受到反垄断法的规制，以平衡社会各方利益，维持良好的竞争环境。论文网
